Terms of Service

1. Acceptance of Terms

By accessing or using the SpecForge service ("Service"), you agree to be bound by these Terms of Service ("Terms") and the SpecForge Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of the terms, then you may not access the Service.

2. Changes to Terms

SpecForge reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

3. The Service and AI Output

  • Service Description: SpecForge is an AI-powered tool designed to assist with product requirements, specification generation, and project scoping.
  • Accuracy of AI Output: The Service utilizes advanced machine learning models (AI). You acknowledge that AI output ("Artifacts") may occasionally be inaccurate, incomplete, or biased. You are solely responsible for reviewing, verifying, and validating all Artifacts before implementation or distribution.
  • No Warranty: SpecForge does not warrant the completeness, safety, or suitability of the Artifacts for any specific project or use case.

4. Accounts and Membership

  • Eligibility: By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate, complete, and current at all times.
  • Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
  • Suspension/Termination: SpecForge may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
  • Data Security: Your personal and company data is handled according to our Privacy Policy. We use industry-standard security measures to protect your data stored in our Firebase Firestore database.

5. Intellectual Property

  • Our Property: The Service and its original content, features, and functionality are and will remain the exclusive property of SpecForge and its licensors.
  • User Input & Output: You retain ownership of all input data you provide to the Service. SpecForge assigns to you all its right, title, and interest in and to the Artifacts generated by the Service based on your input.
  • License to SpecForge: You grant SpecForge a worldwide, non-exclusive, royalty-free license to use, store, and process your input data to operate, maintain, and improve the Service, including training our models, subject to the limitations set forth in our Privacy Policy.

6. Subscription and Payment

  • Fees: Some parts of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring, periodic basis (e.g., monthly or annually).
  • Free Trial: SpecForge may, at its sole discretion, offer a Subscription with a free trial for a limited period. We reserve the right to modify or cancel the free trial offer at any time without notice.
  • Cancellations: You may cancel your Subscription renewal at any time. You will retain access to the Subscription features until the end of your current billing period.
  • Refunds: All fees are non-refundable, except as required by law.

7. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or to promote illegal activities.
  • To generate content that is hateful, abusive, threatening, or obscene.
  • To impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • In any way that infringes upon the rights of others, including copyright, trademark, or privacy rights.
  • To transmit any malware, viruses, or other harmful computer code.

8. Disclaimer of Warranty

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SPECFORGE DOES NOT WARRANT THAT (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

9. Limitation of Liability

IN NO EVENT SHALL SPECFORGE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.
